Calgary police officials seek criminal defense

Two law enforcement affiliates are facing serious charges. The president of the Calgary Police Association as well as a police constable attached to that department are facing assault and perjury charges in relation to a 2008 arrest. Both individuals have sought criminal defense representation to combat these allegations. 

The report dates back to Aug. 31, 2008, when the two officers were responsible for arresting a man during a routine traffic stop. The man was accused of uttering threats toward a police officer, but was later acquitted in 2011 when a judge ruled neither officer was a credible witness. Witness testimony, as well as video captured by witnesses in a nearby building, appear to show both officers handling the man violently, striking him repeatedly with batons before throwing him into the back of a police van and slamming the doors on his legs. 

The issue was not investigated at the time. In 2013 the accused man filed a complaint which led to a new investigation of the two officers. The CPA president now stands charged with assault with a deadly weapon as well as perjury, and the constable is charged with assault causing bodily harm. They are due back in court in early February. 

Criminal charges of this type are serious when filed against any private citizen in Calgary, but they carry special weight for law enforcement officers. If they are found guilty, their careers in policing could be effectively over. This is why it will be important for criminal defense representation to carefully review the witness testimony and video evidence of the alleged incident in order to determine how it could influence the court case and to plan an effective defense against the accusations.
