Criminal defense: man faces charges in alleged hit-and-run

A 47-year-old man is facing serious charges in the death of another man last year, according to local sources. Calgary authorities arrested the man some six months after an alleged hit-and-run that killed a 54-year-old man last November. The charges were formally announced on May 10, and it is believed the man has been taken into custody. It is unknown if he has sought criminal defense representation at this time. 

According to the police report from Nov. 5, 2016, the 54-year-old man was walking on 17th Avenue S.E. late at night when the accident occurred. A truck believed to be driven by the younger man struck and killed him before leaving the scene of the accident. The pedestrian's body was discovered later, lying on the side of the road. 

Police discovered the truck the next day, but were unable to confirm who had been driving it at the time of the accident. Their investigation continued for the next six months until they arrested the 47-year-old man. He now faces charges of hit-and-run causing death, as well as dangerous operation of a motor vehicle. 

With so much time having elapsed between the accident and the charges being filed, it may be difficult for Calgary police to build a case against the defendant. The onus is on the prosecution to prove the man knowingly struck the pedestrian and fled the scene. Criminal defense representatives may wish to review any evidence police wish to enter into consideration by the court in order to determine its viability in supporting the prosecution's case.
