A complainant does not personally “press” or withdraw a criminal charge. Once police lay a charge, the Crown Prosecutor decides whether the prosecution will continue.
A charge may be withdrawn where the evidence does not provide a reasonable likelihood of conviction or where continuing the prosecution would not be in the public interest. Defence counsel can identify weaknesses in the evidence and make submissions to the Crown, but the ultimate decision belongs to the Crown.
