What are Bail Hearings?
When you are charged with a criminal offence, you are either charged and released, or charged and detained, generally speaking. If it’s the latter, there will be a bail hearing to determine if you should be released. The costs, applicable guarantors (known as sureties), and conditions of your release will all be determined at your bail hearing.
Hiring a Lawyer
Hiring a lawyer for your bail hearing is the best way to improve your chances of getting released.
At Muenz Criminal Law, our experienced Calgary Criminal Defence Lawyers can provide you with legal support, advice, and representation at your bail hearing. Our legal representation will ensure not only that you have the best possible chance of being released at your bail hearing but also that your release conditions are reasonable.
What the Court Considers
At a bail hearing, the court considers whether you will attend court as required, whether your release could create a risk to the public, and the seriousness of the charge and surrounding circumstances. Your criminal record, history of following court orders, ties to the community and proposed release plan may also be important.
A well-prepared release plan can address these concerns. It may include a suitable address, reasonable conditions and, where necessary, a surety who agrees to supervise you. Sometimes a short delay is helpful so that your lawyer can obtain the necessary information, speak with the Crown and present a practical plan that gives you the best opportunity for release on reasonable conditions.

Frequently asked
Questions we hear most.
Yes. A lawyer can ask the Crown to agree to a change. If the Crown does not agree, it may be necessary to apply to the court.
Until a condition is formally changed, you must continue to follow it. This remains true even if another person tells you that contact or attendance is permitted. Breaching a bail condition can lead to a new charge and another arrest.
Not always. A surety is a responsible person who agrees to supervise you and help ensure that you follow your bail conditions.
A surety may be helpful in a serious case or where the court has concerns about your release. In other cases, a suitable address and reasonable conditions may be enough.
The court will consider:
- Whether you will attend court as required;
- Whether your release could create a risk to the public; and
- The seriousness of the charge and the surrounding circumstances.
Your criminal record, history of following court orders, ties to the community and proposed release plan may also be important.
If the police do not release you, you will normally appear before a justice within 24 hours, or as soon as one is available.
The bail hearing may take place immediately, but sometimes a short delay is needed to obtain information, speak with the Crown and prepare a proper release plan.
