The complainant cannot personally withdraw the charge. Once the police have laid a charge, the Crown Prosecutor decides whether the case will continue. This remains true even if the complainant does not want to testify or wishes to resume the relationship.

The complainant’s position may be considered, but it is only one factor. The Crown will also assess the 911 call, police observations, photographs, medical evidence, witness statements and any history involving the parties.
