A first IRS: FAIL ordinarily results in:
- An immediate 90-day licence suspension;
- A further 12 months during which the driver may participate in the ignition-interlock program;
- A 30-day vehicle seizure;
- A $1,000 administrative penalty plus a 20% victim fine surcharge; and
- Completion of the required remedial education program.
A driver who does not participate in the ignition-interlock program cannot legally drive during the additional suspension period. Penalties increase considerably for subsequent occurrences.
